Who qualifies for refugee protection in Canada?
If you are unable to return to your home country due to a well-founded fear of persecution based on your race, religion, nationality, political opinion, or membership in a particular social group, you may be eligible for protection in Canada.
In some cases, individuals may not meet the criteria for refugee protection. However, they may still qualify for protection in Canada if they face a risk of torture as defined by the Convention Against Torture or a risk to their life, or a risk of cruel and unusual treatment or punishment.
To qualify for protection, individuals must demonstrate that they are unable or unwilling to avail themselves of the protection of their home country, that the risk is widespread and not faced generally by other individuals in the country, and that the risk is not caused by the country’s inability to provide adequate healthcare. Sanctions must also be imposed in accordance with accepted international standards.

To make a refugee claim in Canada, the individual must first arrive in Canada or be in Canada due to exceptional circumstances. They can then submit a claim for refugee protection with the Immigration and Refugee Board of Canada (IRB).
Yes, if your refugee claim is rejected by the IRB, you can appeal the decision to the Refugee Appeal Division (RAD) of the IRB. However, there are strict timelines for filing an appeal, so it’s crucial to seek legal advice promptly.
If your refugee claim is approved, you will be granted refugee status in Canada, which will allow you to remain in the country and eventually apply for permanent residency. You may also be eligible for certain social services and benefits, such as healthcare and education.
An experienced immigration lawyer can provide critical guidance and support throughout the refugee claim process, including assisting with the preparation and submission of the claim, representing you in hearings, and appealing negative decisions. They can also help you navigate any legal challenges that may arise during the process.
