The Temporary Foreign Worker Program (TFWP) is a program that allows Canadian employers to hire foreign workers for temporary work when qualified Canadian citizens or permanent residents are not available to fill the position.

There are two types of work permits under the TFWP: Labour Market Impact Assessment (LMIA) based work permits and LMIA-exempt work permits.

To apply for a work permit under the TFWP, you must first obtain a positive LMIA, unless the position is exempt from the LMIA requirement. Once you have obtained a positive LMIA, you can then apply for a work permit.

An LMIA (Labour Market Impact Assessment) is a document issued by Employment and Social Development Canada (ESDC) that assesses the impact of hiring a foreign worker on Canada’s labour market. It is generally required before a foreign worker can be hired through the TFWP, unless the position is exempt.

During an LMIA application, factors such as the availability of Canadian citizens or permanent residents to fill the position, the wages and working conditions being offered, and the employer’s compliance with previous employment standards are all considered.
